The ASU was made aware this week of a clause in some new contracts at Our Watch which seeks to remove redundancy entitlements should funding dry up.

The advice from our legal team is that redundancy entitlements are provided for in the National Employment Standards within the Fair Work Act, and therefore cannot be taken away by a clause in a contract.

Your ASU Organiser Tim Sullivan will be meeting with Our Watch HR by phone on Monday to advise of our position and propose that contracts be reissued without this clause. Concerns will also be raised that the handling of contracts within the ELMO system puts undue pressure on workers to sign contracts without reasonable time to consider their contents, as other duties on the ELMO system are obstructed by the unsigned contract.

We will keep you up to date on progress, but for now rest assured that whether you have already signed the contract or not, your union is on the case and will fight for your redundancy entitlements should the need arise.
