ASU wins clarity for Perm Part Time Irregular workers & More

ASU members and delegates working together have at long last got the matter of all staff on PPTI contracts getting full access to personal/carers leave resolved. This has been a protracted matter and well done to everybody involved. It is a big win for ASU members, and non-members yet to join their union! A special mention is due to the passionate library member who did lots of their own research and was unrelenting in pushing this issue all the way. See below for all the relevant details.

ASU will be issuing a newsletter shortly to all members and seeking items for the next Staff Consultative Committee meeting in November. A key item of particular interest to ASU delegates and officials is an update on Council's use of temporary, Fixed-Term Employees, contractors, agency staff and secondment staff. At a recent staff induction attended by the ASU 15 of 16 new inductees were contractors/agency staff. Not OK COM! We will be working with delegates and members to turn this trend around.
1)Personal/Carers leave without rostered shifts
1.1)During ordinary library hours and other staff on PPTI contracts (Monday to Saturday noon) employees on part-time irregular contracts will be able to access paid personal leave without having a rostered shift if a certificate from a legally qualified medical practitioner is provided. Please see Enterprise Agreement 2016 (EA) Clause 56.9.4 for further detail on the requirement to provide a medical certificate.
1.2)For sick leave, the maximum number of hours per day that employees can apply for paid personal leave will be the length of an ordinary (average) day for library staff (7 hours).
1.3)For other medical attendances, the maximum number of hours per attendance that employees can claim will be 4 hours as per EA Clause 56.10. A certificate of attendance will be required for paid leave.
1.4)For carer’s leave without a rostered shift, employees on part-time irregular contracts will be able to access paid personal leave without having a rostered shift if a medical certificate or statutory declaration that establishes the illness or injury of the person concerned is provided (EA Clause 56.18). The duration of such leave shall be up to a maximum of 7 hours (the average day for library staff).
1.5)All paid leave will be deducted from leave credits (entitlements) in the usual way.
1.6)The provisions above will not apply to Saturday afternoons or Sundays.
2)Personal leave with rostered shifts
2.1)In addition to the provisions above, in normal circumstances, employees will continue to be able to take paid sick leave without providing a medical certificate up to five instances per year in line with EA clause 56.9.3. Personal leave will be paid for the number of rostered hours employees are unable to complete due to sickness on each occasion.
2.2)Employees shall also be entitled to access carer’s leave without providing a medical certificate or statutory declaration for the duration of rostered shifts they are unable to complete due to caring responsibilities.
2.3)The provisions in this section shall also apply to Saturday afternoons and Sundays.
