ASU Organiser and Delegates have been engaging in ongoing discussions with management in regard to the clarification of the below EBA clause as to when they qualify for Meal Allowance payment.

10.5.2 Meal Allowance
An employee shall be paid an overtime meal allowance of $15.94 per shift when the employee is required to work for more than two hours after the rostered shift ceases and they have not been notified of the overtime the previous day or earlier. The provisions of this clause do not apply where a meal is provided by Citywide.

Points of clarification as per the above clause.

  1. The employee is required to work for more than two hours after the normal rostered shift ceases.
  2. What is the definition the previous day or earlier in relation to being notified of the overtime previous day or earlier definition?
  3. Citywide don’t provide a meal.

Example
An employee starts work at 4.00am Tuesday – 12.00pm
Rostered on to work Wednesday at 5.00am – 1.00pm

An employee should be notified during the hours of work on the Tuesday for overtime on Wednesday.  If the employee has not been notified of the overtime during this period and instead have been asked to work overtime after the previous shift has finished, then they should qualify for meal allowance provided they meet 1 and 2 above.

We still have a long way to go over the next few weeks, so speak to your ASU delegates and encourage non-members to join the ASU which is fighting hard for everyone.
