The ASU understands that CoM managers have instructed team members to submit any flexible working arrangement (FWA) requests by a specific date for consideration.

While the ASU understands that CoM has certain operational requirements in regard to consideration of FWAs, it is important to note that any request for an FWA that is submitted after the cut-off date is still valid and must be considered.

A request cannot be refused consideration or rejection because it was ‘late’ in being submitted.

The ASU again reminds members of their rights under the Fair Work Act and reiterates that the ASU will vigorously support any member unfairly refused or discriminated against in regard to FWAs.
It is against the law for an employer to refuse flexible work requests from employees who meet certain attributes unless there are reasonable business grounds. Employers must explain those reasons in a written response.
