On Wednesday, ASU became aware that incorrect information had been provided by CFA Management regarding who is eligible to participate in protected industrial action. Some members had been advised that only people who were members at the time of the protected action ballot in March were eligible to participate.
ASU immediately wrote to Management to point out that this was incorrect, and the issuing of such information potentially breached the General Protections provisions in the Fair Work Act.
We are pleased that CFA admitted their mistake and have subsequently issued a communication to all members clarifying this. To be clear, anyone who is a member of the ASU can participate in bans notified by the ASU, regardless of when they joined.

Two points to be aware of:
- Only union members can participate in protected industrial action. If non-members want to participate, they can join the ASU and will be protected straight away.
- Protected Industrial Action is just that – protected. You cannot be disciplined, coerced, or instructed not to carry out bans. If this occurs, contact your delegate or Organiser Matt Price immediately.
