ASU members have recently contacted union delegates and the union office, with confusion regarding entitlements for the Melbourne Cup Day holiday.

Clause 49 Public Holidays states: Melbourne Cup Day will not be observed as a public holiday. For Part-time and Full-time employees who are Geelong based, Employees may take any day between Geelong Cup Day and 31 December which is approved by the employees Line Manager off work without loss of pay in substitution for the Melbourne Cup public holiday and Part-time and Full-time employees who are Warrnambool based, Employees may take any day between Warrnambool Cup Day and 31 December which is approved by the Employees Line Manager off work without loss of pay in substitution for the Melbourne Cup public holiday.

For Casual Employees, Geelong Cup Day will be the substituted public holiday for Geelong based Employees and Warrnambool Cup Day will be the substituted public holiday for Warrnambool based employees. Casual employees are only entitled to be paid if they are rostered to work on Geelong Cup Day and have no entitlement to pay if they are not rostered to work on Geelong Cup Day.

So, if you are a full time or part time employee rostered to work on Tuesday 6 November this day is not observed as a public holiday.

If you are Geelong based then you elect any day between the Geelong Cup Day and 31 December as your replacement day.

Warrnambool employees elect a day between Warrnambool Cup Day and 31 December.

Casual employees observe Geelong or Warrnambool Cup Day as their public holiday.
