As you know your enterprise agreement was voted up by staff and awaiting certification by the Fair Commission.
However, RAV, the ASU, your delegates and other staff representatives were notified by Deputy President Young that they had some concerns about your agreement meeting the better off over all test (BOOT) requirements.
We can confirm that RAV, the ASU, your delegates and other staff representatives attended a Fair Work Commission conference on 5th August. It was agreed that the application for your agreement to be certified would be withdrawn so the concerns Deputy President Young had regarding the document meeting the (BOOT) could be resolved.
One of the main concerns was the enterprise agreement document did not contain a wage PayScale and therefore unable to be satisfied that you wages are better off overall. Some of the other concerns were clauses that are currently in your enterprise agreement and were previously certified as acceptable but this time it is they were deemed they are not acceptable.
RAV, the ASU, your delegates and other staff representatives will work to resolve these matters and then the agreement access period will recommence, and the agreement put out to staff to vote on.
If 50% plus 1 of the staff that vote, vote yes, the agreement will then be sent to Fair Work again for the certification process.
