ASU to utilise new ‘Same Job-Same Pay’ provisions at VicRoads

14 March 2024

Last year the Commonwealth Government passed a number of improvements to the Fair Work Act, including a requirement that agency/labour hire workers receive the same pay as directly employed workers where there is an Enterprise Agreement.

VicRoads has over 200 agency-employed staff performing work that is the same as directly employed staff, including drive tests, vehicle inspections, and counter work.

Yet these agency workers typically receive around $31 - $33ph as casuals.

If they were employed as casuals directly under the ASU Enterprise Agreement, their minimum rate would be $37.85ph.

So the ASU is seeking to utilise these new laws to get that fixed, so that these workers get paid Union negotiated wages, not labour hire exploitation wages.

The ASU will soon be making an application to the Fair Work Commission, and we will update members of progress in this important case.
